A birth injury, which is also referred to as birth trauma, is an injury that occurs to the baby as a result of complications during delivery. A birth injury can range from mild to severe. Minor bruising is an example of a mild birth injury. Severe nerve damage is an example of a severe, or traumatic birth injury.
What Causes Birth Injuries?
Breech delivery is a common cause of birth injuries. The baby is supposed to come out head first. A breech delivery occurs when the legs or buttocks are presented first. A difficult labor or childbirth can also cause a birth injury. Additionally, if the shape and size of the mother’s pelvis is not adequate for vaginal delivery, then the baby is more likely to get injured during delivery.
In most cases, birth injuries are not caused by the wrongdoing of a healthcare professional. However, many babies have suffered a traumatic birth injury as the result of a healthcare professional’s negligence. Below are some examples of medical malpractice that can lead to a birth injury:
Failing to Anticipate Possible Birth Complications
Women who have had complications through their pregnancy are very likely to have complications during their delivery. Women who are pregnant with very large babies are also more likely to have complications. If a healthcare professional fails to anticipate and properly prepare for possible birth complications, then he or she has committed medical malpractice.
Improper Use of Delivery Instruments
Vacuum extractors and forceps are commonly used during delivery. If these instruments are used improperly, injury can result.
Improper Use of Pitocin
Pitocin is a medication that helps speed up labor. If this medication is not properly used, birth injury can result.
Delaying the Decision to Perform a C-Section
In some cases, C-sections may be medically necessary to save the life of the mother and the child. If a doctor delays the decision to perform a C-section, that is an act of negligence.
