However, you will only be eligible to pursue damages if your level of liability is 50% or lower. Furthermore, the amount you can recover will be reduced in proportion to your level of fault.
For example, if you endured $100,000 worth of damages but were found to be 20% at fault, you would only be able to claim $80,000 or 80% of the losses you incurred.
What Crash in Dallas Data Tells You Before You File a Claim
Dallas made meaningful progress on road safety in 2025, but the numbers still reflect how serious the risk is for drivers, pedestrians, and cyclists across the city.
Fatal accidents fell by nearly half in 2025. According to city data compiled through the Texas Department of Transportation’s Crash Records Information System, Dallas recorded 107 accidents resulting in fatalities in 2025, down from 208 in 2024. That represents the lowest number of deadly crashes on Dallas roads since at least 2015, and marks the first time since 2019 that fewer than 200 accidents resulted in a death.
Serious injuries also dropped significantly. Across all accident types, 595 crashes resulted in serious injury in 2025, compared to 935 the year before. That is still nearly two serious injury crashes every day in a single city.
Speeding is the leading cause of fatal crashes in Dallas. Of the 108 fatal accidents recorded in 2025, 44 are attributed to speeding. Speed has been the top contributing factor in fatal crashes in nine of the last ten years. If another driver’s excessive speed caused your accident, that pattern is well-documented and legally significant.
Impairment was the second leading cause of fatal crashes. Impaired driving accounted for 23 fatal accidents in 2025. Dallas Police Department efforts including DWI enforcement resulted in 451 arrests over the course of the year. When a driver was impaired at the time of your crash, that conduct can support a stronger civil claim and may also open the door to punitive damages.
Around 7% of Dallas roads account for more than half of all severe crashes. The city’s own data identifies a concentrated set of high-risk corridors that generate a disproportionate share of serious accidents.
